Real World Appeal — Terms of Service

These Terms of Service ("Terms") govern your access to and use of Real World Appeal (the "Service"), operated at realworldappeal.com. Please read them carefully — they include important disclaimers about the AI-generated, subjective nature of our reports, a limitation of our liability, and an agreement to resolve most disputes through arbitration and to waive class actions. By creating an account, uploading a photo, taking a test, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who We Are and What This Agreement Covers
Real World Appeal ("Real World Appeal," "we," "us," or "our") provides an AI-powered tool that analyzes user-uploaded photos and questionnaire answers to produce a first-impression appeal report for men. These Terms form a binding legal contract between you and Real World Appeal covering your use of the website, the test flow, the reports, paid features, and any related content or communications (collectively, the "Service").
These Terms incorporate by reference our Privacy Policy, which explains what personal data we collect and how we handle it. Where the two documents overlap, the Privacy Policy controls on questions of data handling and your privacy rights.
If you use the Service on behalf of anyone other than yourself, you represent that you are authorized to accept these Terms for them. In practice, the Service is intended for use by an individual analyzing photos of himself, and only that person may upload photos and receive a report.
We may offer specific features under supplemental terms presented at the point of use (for example, at checkout or when unlocking a member module). Where a supplemental term conflicts with these Terms, the supplemental term controls for that feature only.
2. Eligibility and Accounts
The Service is strictly for adults. You must be at least 18 years old to use the Service. By using it, you represent and warrant that you are 18 or older. We do not knowingly permit anyone under 18 to use the Service or to appear in any uploaded photo, and we will remove such content and terminate accounts when we become aware of a violation.
You may take one test as an anonymous visitor. That test is tied to an identifier stored in a browser cookie on your device. If you later create an account, you may claim that anonymous test and associate it with your account.
Accounts are created and authenticated through our identity provider, Clerk, using email and password or a supported OAuth provider (such as signing in with a third-party account). You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us promptly at contact@realworldappeal.com if you suspect unauthorized access.
You agree to provide accurate account information and to keep it current. We may suspend, limit, or terminate accounts that we reasonably believe are fraudulent, abusive, shared without authorization, or in violation of these Terms.
Some questionnaire inputs (height, weight, body-fat percentage, lifting experience) are self-reported. You are responsible for the accuracy of what you enter; inaccurate inputs will produce a less useful report.
3. Description of the Service and How Reports Are Generated
The Service asks you to upload up to three photos of yourself — a face photo, a daily-outfit photo, and an optional shirtless/physique photo — and to answer a short questionnaire. It then returns a first-impression appeal report.
The analysis is produced by a third-party large language model provided by Google (Google Gemini), running on Google Cloud infrastructure. The report is an interpretation of your inputs generated by that model. It is not authored, reviewed, or endorsed by a human expert, and it does not reflect a personal opinion of anyone at Real World Appeal.
We may add, change, or remove features, modules, and scoring methods at any time as we improve the Service. Reports generated at different times, or with different photos or inputs, may differ.
4. Important Disclaimer — Subjective, AI-Generated Estimates, Not Advice
Please read this section carefully. It defines the fundamental nature and limits of what the Service provides, and it applies to every score, module, and recommendation.
Results are subjective, probabilistic, AI-generated estimates. They are NOT objective measurements, facts, or truths about you. Attractiveness and "first impressions" are inherently subjective and vary by viewer, culture, context, and mood. Any number, rank, percentile, "ceiling," or personality type is an approximation produced by a statistical model, not a precise or authoritative assessment.
The Service is for entertainment and self-improvement purposes only. It is NOT professional advice of any kind. In particular, nothing in a report is medical, dermatological, nutritional, fitness, psychological, mental-health, dating, financial, or legal advice, and it must not be relied upon as a substitute for a qualified professional. Do not start, stop, or change any diet, exercise program, medical treatment, medication, cosmetic procedure, or health decision based on a report. Consult a licensed professional before acting on anything health-related.
A report is NOT a judgment of your worth, character, health, desirability, or value as a person. A score is not a verdict about you. If any content leaves you feeling distressed, please step away and, if you are struggling, reach out to a qualified mental-health professional or a local support resource.
AI systems can be wrong, biased, inconsistent, or produce content that does not reflect reality. The model may misread a photo, misinterpret an input, or generate recommendations that are inaccurate or not suitable for you. You are solely responsible for how you interpret and act on any output.
Because results depend on the photos and information you provide, on the AI model's behavior, and on factors outside our control, we do not warrant that any result is accurate, reliable, complete, current, or fit for any particular purpose.
5. Your Content, Photo Uploads, and Licenses
"Your Content" means the photos you upload, the questionnaire answers you provide, and the reports generated for you. As between you and us, you retain ownership of the photos and inputs you provide, and the personalized report content generated for you is yours to keep and use for your own personal purposes.
To operate the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, and analyze Your Content solely for the purpose of providing, maintaining, securing, and supporting the Service — including sending your photos and inputs to our AI provider to generate your report, and storing your reports so you can access them. This license ends when the relevant content is deleted, except for backups or records we are required or permitted to retain as described in Section 9 and the Privacy Policy.
Your uploaded photos are used only to generate your report. We do not use your uploaded photos to train our own or any third party's AI models, beyond the processing that our AI provider necessarily performs to return a result for your request. Our AI provider handles the photos it receives under its own terms as our sub-processor; we do not authorize any additional model-training use of your photos by that provider beyond such processing.
You represent and warrant that, for every photo you upload: (a) it depicts you and only you; (b) you have all rights necessary to upload it and to grant the license above; and (c) it does not violate these Terms or any law.
We store uploaded photos through our storage provider (UploadThing) and may compute and retain a cryptographic hash of each photo to detect duplicates and prevent abuse (including a 24-hour duplicate-photo gate). We may remove any content that violates these Terms.
6. Prohibited Uses and Content
You agree not to upload, submit, or use the Service to process any of the following:
In addition, you agree not to: use the Service to evaluate, rate, rank, surveil, or harass any other person; reverse engineer, decompile, or attempt to extract our models, prompts, scoring logic, or source code; scrape, crawl, or harvest data from the Service; use bots, scripts, or other automated means to access the Service or to create multiple or fake accounts; circumvent usage limits, the duplicate-photo gate, rate limits, or paywalls; resell, sublicense, or commercially redistribute the Service or its outputs; or interfere with, overload, or attempt to gain unauthorized access to the Service or its infrastructure.
You are responsible for ensuring your use complies with all laws that apply to you. Uploading another person's image or a minor's image is a serious violation and may be reported to the appropriate authorities where required by law.
Violation of this section may result in immediate suspension or termination, removal of content, and forfeiture of access to paid features without refund, in addition to any other remedies available to us.
7. Payments, Pricing, Subscriptions, and Refunds
Some features are free and some require payment. Payments are processed by our payment provider, Stripe. We never receive or store your full card number; Stripe holds and processes your card data under its own terms and security controls. By paying, you also agree to Stripe's applicable terms.
We currently offer one-time per-report unlocks (approximately $10 during promotional pricing and approximately $30 at regular pricing) and monthly subscriptions (approximately $19.90 and $49.90 tiers). The exact price, currency, taxes, and any promotional discount shown at checkout at the time of purchase govern your transaction.
Prices, tiers, promotions, and the features included in each are subject to change. We may change pricing prospectively; for active subscriptions, price changes take effect on a following billing cycle and, where required, after notice to you. Promotional pricing is temporary and may end at any time.
Subscriptions renew automatically each month and are billed in advance until you cancel. You can cancel at any time; cancellation stops future renewals and takes effect at the end of the current paid period. Unless required by law, we do not provide prorated refunds for the unused portion of a billing period.
Because our reports are digital content that is generated and delivered on demand, all sales are final and non-refundable once the analysis has been delivered, except where a refund is required by applicable law. Where you are a consumer with a statutory right of withdrawal, you acknowledge and agree that by requesting immediate generation of your report you consent to delivery beginning before any withdrawal period ends and, to the extent permitted by law, that you lose any such withdrawal right once delivery has begun. Nothing in this section limits rights that cannot be waived under mandatory consumer-protection law.
You are responsible for any applicable taxes not collected by us, and for keeping your payment method valid. Failed or reversed payments, chargebacks, or fraud may result in suspension of paid features or your account.
8. Intellectual Property
The Service and everything that makes it up — including the website, software, design, user interface, text, graphics, our AI prompts and prompt engineering, scoring methodology, the "appeal personality" type system, module structures, our name, logo, and other brand elements — are owned by Real World Appeal or our licensors and are protected by intellectual-property and other laws. Except for the rights expressly granted in these Terms, we reserve all rights.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service and your reports for your own personal, non-commercial purposes, subject to these Terms.
You may not copy, modify, distribute, sell, license, publicly display, or create derivative works from any part of the Service (other than your own report content for your personal use) without our prior written permission. You may not remove or obscure any proprietary notices.
Marketing pages may include stock imagery licensed from third parties (for example, Pexels). Those images are used under their respective licenses and are not part of any user's report or an assessment of any user.
If you send us feedback, ideas, or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or obligation to you.
9. Data, Privacy, Retention, and Your Rights
Our handling of personal data is described in detail in our Privacy Policy. This section summarizes key points; the Privacy Policy controls.
We collect and process: account information (email, name, and avatar via Clerk); uploaded photos and their hashes; questionnaire answers; generated reports; payment records (Stripe holds card data — we never see full card numbers); and first-party analytics events, including page views, clicks, session activity, coarse city-level geolocation derived from IP, and a salted hash of your IP address. We do not store raw IP addresses. We also use cookies for authentication sessions, anonymous-report identification, and consent.
We use this data to generate and store your reports, operate your account, process payments, prevent abuse (including the 24-hour duplicate-photo gate), improve the product, and produce aggregated or de-identified analytics.
To deliver the Service we rely on sub-processors and third-party providers, including Clerk (authentication), Stripe (payments), UploadThing (photo storage), Google Gemini / Google Cloud (AI analysis of photos), Vercel (hosting), Neon (Postgres database), Cloudflare (DNS and email routing), Google Search Console, and Pexels (stock imagery on the marketing site). Each processes data under its own terms.
You may delete your account and reports. On deletion, your reports and uploaded photos are removed. Some records — such as payment and tax records — may be retained where required or permitted by law. To request access, correction, deletion, or export of your data, email contact@realworldappeal.com.
Depending on where you live, you may have rights under the GDPR (including access, rectification, erasure, portability, objection, restriction, and withdrawal of consent) and under the CCPA/CPRA (including the right to know, delete, and correct, and to opt out of any "sale" or "sharing"). We do not sell your personal data. Our processing occurs in the United States, so using the Service involves an international transfer of your data to the U.S.; by using the Service you understand this. See the Privacy Policy for how we handle such transfers and how to exercise your rights.
10. Third-Party Services
The Service depends on and integrates with third-party providers, including those listed in Section 9. Your use of those services through Real World Appeal may also be subject to their own terms and privacy policies.
We do not control third-party providers and are not responsible for their acts, omissions, availability, security, accuracy, or content. In particular, the AI analysis is produced by a third-party model whose behavior and outputs we do not control and cannot guarantee.
Any links to external websites are provided for convenience only and do not imply our endorsement. We are not responsible for external sites or their content.
If a third-party provider changes, restricts, or discontinues its service, features that depend on it may be affected, degraded, or removed.
11. Service Availability and Changes
We provide the Service on an ongoing but not guaranteed basis. We do not promise that the Service will be uninterrupted, error-free, secure, or available at any particular time. We may perform maintenance, and outages may occur, including due to third-party providers.
We may add, modify, suspend, or discontinue any part of the Service — including features, modules, scoring methods, pricing, and free allowances — at any time, with or without notice, subject to any rights you have under applicable law and Section 7 regarding active subscriptions.
We may impose limits on usage (such as rate limits, upload limits, and the duplicate-photo gate) and may change those limits to protect the Service and our users.
We are not liable to you for any modification, suspension, or discontinuation of the Service, except as expressly required by law or these Terms.
12. Disclaimer of Warranties
THE SERVICE, INCLUDING ALL REPORTS, SCORES, MODULES, RECOMMENDATIONS, AND OTHER OUTPUTS, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT ANY RESULT IS ACCURATE, RELIABLE, COMPLETE, UNBIASED, OR CORRECT, THAT OUTPUTS ARE FIT FOR ANY DECISION YOU MAKE, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. AS EXPLAINED IN SECTION 4, ALL RESULTS ARE SUBJECTIVE, PROBABILISTIC, AI-GENERATED ESTIMATES FOR ENTERTAINMENT AND SELF-IMPROVEMENT ONLY, AND ARE NOT PROFESSIONAL ADVICE.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In that case, such warranties are limited to the minimum extent and shortest duration permitted by law.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, REAL WORLD APPEAL AND ITS OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY, OR FOR ANY EMOTIONAL DISTRESS OR HARM TO SELF-ESTEEM, ARISING OUT OF OR RELATED TO THE SERVICE OR ANY REPORT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This includes, without limitation, any harm arising from your reliance on a score, recommendation, or other output; any decision you make based on a report (including health, fitness, cosmetic, dating, or financial decisions); the inaccuracy, bias, or unavailability of AI-generated content; or the acts or omissions of any third-party provider.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for our gross negligence, willful misconduct, or fraud where non-waivable.
The disclaimers and limitations in this section and in Section 12 are a fundamental basis of the bargain between you and us and reflect the price of the Service; they apply even if a limited remedy fails of its essential purpose.
14. Indemnification
You agree to indemnify, defend, and hold harmless Real World Appeal and its owners, operators, employees, and contractors from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
We may assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us. You will not settle any such matter in a way that imposes any obligation on us without our prior written consent.
15. Term, Suspension, and Termination
These Terms apply for as long as you use the Service. You may stop using the Service at any time and may delete your account and reports as described in Section 9.
We may suspend or terminate your access to all or part of the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by law, to protect the Service or other users, or if the Service is discontinued.
On termination, your right to use the Service ends. We may delete your data in accordance with our Privacy Policy, subject to records we are required or permitted to retain. Termination does not entitle you to a refund except as required by law or Section 7.
Provisions that by their nature should survive termination will survive, including ownership, licenses you granted us that are needed to retain lawful records, disclaimers, limitations of liability, indemnification, and dispute-resolution terms.
16. Governing Law and Dispute Resolution
Except where prohibited by applicable law, these Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the United States and the state in which Real World Appeal is established, without regard to conflict-of-laws principles. This does not deprive you of the protection of mandatory consumer-protection laws of your country of residence where those apply.
Informal resolution first. Before starting any formal proceeding, you agree to try to resolve the dispute informally by emailing contact@realworldappeal.com with a description of the issue and the relief you seek. We will attempt to resolve it in good faith. If it is not resolved within sixty (60) days, either party may proceed to arbitration.
Binding arbitration. To the fullest extent permitted by law, any dispute not resolved informally will be settled by final and binding individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court where eligible, and either party may seek injunctive relief in court to protect intellectual property or prevent unauthorized use of the Service. The arbitration will be conducted by a recognized arbitration provider under its applicable consumer rules.
Class-action waiver. To the fullest extent permitted by law, disputes will be resolved only on an individual basis. YOU AND REAL WORLD APPEAL WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING, AND THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court, and the rest of this section will remain in effect.
Where mandatory law gives you a non-waivable right to bring a claim in the courts of your home jurisdiction, or where arbitration or the class-action waiver is not enforceable against you, those provisions apply only to the extent permitted, and nothing in this section overrides such rights.
Any claim must be brought within the time period allowed by applicable law.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will change the "Effective date / Last updated" line at the top and, for material changes, provide reasonable notice — for example, by posting a notice on the Service or contacting you where appropriate.
Changes take effect when posted, unless we state a later effective date or a longer notice period is required by law. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the Service and may delete your account. Changes do not apply retroactively to any dispute that arose before the change took effect.
